        SEQRA DETERMINATION OF SIGNIFICANCE
       RIGA WATER IMPROVEMENT BENEFIT AREA NO. 1
____________________________________________________________
 
 
            WHEREAS, the Town Board of Riga shall consider the approval of the construction of water improvements in the Town of Riga outside the Village of Churchville in an area known as the Riga Water Improvement Benefit Area No.1, all of which is located in the Town of Riga, County of Monroe and State of New York; and
 
             WHEREAS, as project sponsor, the Town Board directed the Town Engineer, Chatfield Engineers, P.C., to prepare a Full Environmental Assessment Form, a copy of which is on file with the Town Clerk; and
 
            WHEREAS, all involved agencies, as the same are defined by SEQRA and the regulations promulgated thereunder, were duly advised, by written notice dated November 12, 2009, that the Town Board of the Town of Riga intended to declare itself Lead Agency and requested any involved agency objecting thereto to contact the Town of Riga within thirty (30) days; and no involved agency objected to the Town of Riga being designated Lead Agency; and
 
            WHEREAS, all involved agencies were mailed or delivered a copy of Part 1 of the Full Environmental Assessment Form together with the notice that the Town Board intended to declare itself Lead Agency; and
 
            WHEREAS, the Town Board has duly reviewed and considered the Environmental Assessment Form, the Engineer's Report for the proposed Riga Water Improvement Benefit Area No.1, the Preliminary Notice of Intent filing prepared for the project by the Town Engineer under the provisions of the Agriculture and Markets Law, as well as all the evidence and information obtained at a public hearing held on December 16, 2009 at 7:00 p.m. relating to the water improvement project, and the Board has duly considered the impacts which reasonably may be expected to result from the proposed action by using the criteria set forth in Article 8 of the Environmental Conservation Law, the State Environmental Quality Review Act, and applicable regulations promulgated thereunder ("SEQRA"); 

     NOW, THEREFORE, BE IT RESOLVED by this Town Board as follows:
 
            1. That the Town Board of the Town of Riga declares itself Lead Agency for review of the project.
 
            2. That based upon the review and consideration by the Town Board of all of the evidence above described, the Board hereby finds that the object of the above-referenced action, and approval of any financing therefore, (a) will result in no significant “adverse environmental impacts” and (b) no "environmental impact statement" need be prepared, as such quoted terms are defined in SEQRA. The notice of negative declaration of the Town Board is attached hereto and made a part of this resolution for the purposes of SEQRA. This determination constitutes a negative declaration for purposes of SEQRA.
 
            3. That the Town Board’s determination is based upon the reasons set forth in the notice of negative declaration attached hereto, said reasons being incorporated herein by reference..
 
            4. A copy of this resolution, together with the notice of negative declaration, shall be placed on file in the Office of the Town Clerk of the Town of Riga and posted on the Town Clerk’s Bulletin Board where the same shall be available for public inspection during business hours; and the notice of negative declaration shall be filed with all involved agencies, and published in the Environmental Notice Bulletin (“ENB”) and in such newspapers as shall be necessary to conform to the requirements of SEQRA. A copy of this resolution, together with the notice of negative declaration, shall also be posted on the Town of Riga’s web site at www.townofriga.org. .

    This notice is issued pursuant to Part 625 of the implementing regulations pertaining to Article 8 (State     Environmental Quality Review Act) of the Environmental Conservation Law.
 
    The               Town of Riga                                    , as lead agency, has determined that the proposed action described below will not have a significant effect on the environment and a Draft Environmental Impact Statement will not be prepared.

Description of Action:
 
The Town of Riga proposes to create a Water Improvement Benefit Area to serve the remaining portion of the Town not currently on public water. The proposed improvements will consist of a strategic extension of the existing water distribution system to serve the approximately 284 homes currently not on public water plus approximately 21 businesses and commercial properties. 
 
The Project includes the installation of approximately 138,930 linear feet of 6-12” diameter Class 51 Ductile Iron Pipe (DIP) with fire hydrants generally spaced at 600 feet intervals. Fire hydrants are generally located near intersections to provide improved fire fighting capabilities. Gate valves are generally spaced at intervals of 1,000 linear feet and at intersections. All improvements will be completed in accordance with the MCWA Standards.

Reasons Supporting This Determination:

Although this project includes multiple stream crossings of varied categories the appropriate mitigation efforts, including erosion controls and adherence to all storm water regulations will be taken to protect surface runoff. Permit compliance with NYS DEC and US Army Corps of Engineers will be obtained prior to any construction activity. Similar mitigation efforts and compliance to environmental regulations will apply to project design on Robertson Road in a small area of NYS Regulated Freshwater Wetland.
 
The project will address the pressing public health and safety needs, which result from dependence upon individual on-site wells that produce water of limited quality and quantity. The project may provide some opportunity for additional growth within the Water Improvement Benefit Area, since a safe and reliable water supply and fire protection will be available. However, the intent of the project is to meet the existing needs, not to promote growth. The impacts of additional growth are expected to be minimal. No change in the zoning will result from this project.    The project will improve the overall quality of life for the residents of the water benefit area.
 
The estimated water use within the new project area is approximately 66,000 gallons per day. The water will be supplied by the Monroe County Water Authority. There is ample supply to meet this additional demand. Since residents will be discontinuing use of their existing wells, the use of existing groundwater supplies will be reduced in the project area.
 
Although the project will require some water main installation within the 100 year flood plain of Black Creek, it will not result in any adverse impact to the flood plain.
 
The well supplies in the project area have a history of producing limited yields and poor quality water. The project will reduce the dependency on individual well supplies; and provide water that is treated and tested to meet public health standards. The project will also improve firefighting capabilities in the project area.
 
Any negative effects of construction activities will be minimal and temporary in nature. Using proper silt fence and erosion control measures will ensure minimal impact.
 
There will be no adverse impact on plants and animals that make this their habitat.
 
The installation of the watermain will not affect the character, present use or any potential future use of the land and surrounding area. They will enhance the residents’ use of their properties.
 
Chatfield Engineers conducted the SEQR Environmental Assessment for this project.

APPROVAL OF THE RIGA WATER IMPROVEMENT
BENEFIT AREA NO. 1
     UNDER ARTICLE 12-C OF TOWN LAW
__________________________________________________________
     
      WHEREAS, on February 11, 2009, the Town Board of the Town of Riga duly adopted a resolution directing the Town Engineer, Chatfield Engineers, P.C., to supervise the preparation of a general plan, report and map for providing water improvements (water mains, fire hydrants, and all related equipment) in portions of the Town of Riga located outside the Village of Churchville, said area to be known as the Riga Water Improvement Benefit Area No. 1; and
 
      WHEREAS, the proposed water improvement will include approximately 138,930 linear feet of 6-12 inch diameter ductile iron pipe water main and will serve all residents not currently served with public water. Water services consisting of 1 inch minimum Type K cooper tubing will be provided to improved residential and commercial properties at the road right of way line. The water distribution system will also include the normal appurtenances, such as line valves, fire hydrants, air release valves, blow-off valves and related items. The water distribution system will be constructed in one or more phases (or contracts) and will be installed within, or along side of, the road right of ways within the proposed water improvement benefit area that do not have public water; and
 
      WHEREAS, on November 5, 2009, the Town Engineer duly filed said plan, report and map in the Office of the Town Clerk of the Town of Riga; and the Town Board did, on November 11, 2009, duly adopt an order reciting the improvement, the maximum amount proposed to be expended for the improvement, the proposed method of financing to be employed (including the use of Host Benefit Agreement Reserve Funds for the project), the proposed method of apportioning the costs of said improvement, the fact that a plan, map and report describing the same are on file in the Town Clerk's Office for public inspection, and specifying that said Town Board shall meet at the Churchville-Chili Middle School Auditorium located on Fairbanks Rd. in the Town of Riga, New York on the 16th day of December, 2009, at 7 P.M. for the purpose of conducting a public hearing on such proposal to provide such improvement and to hear all persons interested in the subject thereof; and
 
      WHEREAS, such order was duly posted and published as required by law; and
    
      WHEREAS, a hearing in the matter was duly held by the Board on the 16th day of December, 2009, commencing at 7 P.M. at the Churchville-Chili Middle School, and considerable discussion upon the matter having been had and all persons desiring to be heard having been duly heard;
 
      NOW, THEREFORE, upon the evidence obtained by the Town Board at the December 16, 2009 public hearing and upon all other information obtained and reviewed by the Board, it is hereby
 
      RESOLVED AND DETERMINED that the notice of hearing was published and posted as required by law and is otherwise sufficient; and be it further
 
      RESOLVED AND DETERMINED that it is in the public interest to provide for the water improvement above described; and it is further
 
      RESOLVED AND DETERMINED the boundaries of the area within the Town of Riga being benefited by said water improvement are set forth in Schedule A attached hereto and incorporated herein by reference; and be it further
 
     RESOLVED AND DETERMINED, that the maximum amount proposed to be expended for such water improvement (including the cost of construction, easements, engineering fees, legal fees and financing fees) is Nine Million Dollars ($9,000,000); and be it further
 
      RESOLVED AND DETERMINED, that the costs of the proposed water improvement shall be financed from the issuance of bonds, notes, certificates or other indebtedness of the Town of Riga for a period not to exceed forty (40) years; and from the Host Benefit Agreement Reserve Fund established by Local Law No. 3 of 2008 and approved by the electors of the Town of Riga at the General Election held on November 4th, 2008 (hereinafter referred to as “Host Benefit Agreement Reserve Fund”); and be it further
 
      RESOLVED AND DETERMINED that the costs of said water improvement be apportioned / paid as follows:
      A) Upon final approval of the project and creation of the Riga Water Improvement Benefit Area No. 1, One Million Eight Hundred Thousand Dollars (1,800,000) shall be transferred from the Host Benefit Agreement Reserve Fund to the capital fund for the project and shall be used to pay initial project capital costs; and
      B) Subject to future appropriations being made by the Town Board, a maximum of Three Million Four Hundred and Fifty Thousand Dollars ($3,450,000) shall be transferred from the Host Benefit Agreement Reserve Fund to the project's capital fund for repayment of debt service; and repayment of the balance of the debt service relating to the project shall be borne by the several lots and parcels of land located in the benefited area in just proportion to the amount of benefit which the water improvement shall confer upon such lots or parcels of land; and
      C) In the event that all or a part of the Host Benefit Agreement Reserve Funds referred to in paragraph (B) above are not appropriated or are insufficient for repayment of debt service relating to the Riga Water Improvement Benefit Area No. 1, then
                  1) Seventy-Two Percent (72%) of said costs shall be borne by the several lots and parcels of land located in the benefited area in just proportion to the amount of benefit which the water improvement shall confer upon such lots or parcels of land; and
                  2) Twenty-Eight Percent (28%) of said costs shall be borne by the area of the Town of Riga outside the Village of Churchville.   If any of said water improvement costs are borne by the area of the Town of Riga outside the Village of Churchville, such costs shall be assessed, levied and collected from the several lots and parcels of land in such area in the same manner and at the same time as other town charges; and
 
      D) The formula to be used to assess costs within the benefitted area shall be as follows:
                  1) 40% of the annual costs to be assessed will be based on a unit charge system, with a unit defined as follows:
 
Residential and Commercial Properties: 1 unit
Vacant Lots: 0.5 unit
Landlocked Parcels: 0 unit
 
                  2) 60% of the annual costs to be assessed will be based upon the assessed valuation of the taxable parcels within the benefited area; and be it further
 
      RESOLVED, that within ten (10) days after the adoption of this resolution, or within ten (10) days after the Town has received any necessary approval from the State Comptroller, whichever is later, the Town Clerk shall file a certified copy of this resolution in the Monroe County Clerk's Office; and be it further
 
      RESOLVED, that since the costs to be financed by issuance of debt instruments exceeds one-tenth of one percent (.01%) of the full valuation of the taxable real property within the Town of Riga located outside the Village of Churchville, the Town Clerk shall caused to be filed two certified copies of this resolution with the office of the State Department of Audit and Control, at Albany, New York, together with an application by this Board in duplicate for approval of the State Comptroller as provided by the Town Law, Section 209-q; and that such application shall be executed by and in behalf of the Town by the Supervisor of the Town; and it is further
 
      RESOLVED, that this resolution is subject to:
 
      A. A permissive referendum where all town electors may vote; and
 
      B. A permissive referendum where only owners of property located in the Town of Riga outside the Village of Churchville (part-town property owners) may vote; and
 
      C. A permissive referendum where only owners of property within the proposed Riga Water Improvement Benefit Area No. 1 may vote; and be it further            
 
      RESOLVED, that the Town Clerk, within ten (10) days of the adoption of this resolution, shall cause to be published and posted, as required by law, a notice setting forth an abstract of this resolution, the date that it was adopted and a statement as to that it is subject to three (3) permissive referendum as set forth above.

       NOTICE IS HEREBY GIVEN that the Town Board of the Town of Riga, County of Monroe, New York, at a special meeting thereof held on the 29th day of December, 2009, duly adopted a resolution, subject to three (3) permissive referendum as follows:
 
      A. A permissive referendum where all town electors may vote; and
 
      B. A permissive referendum where only owners of property located in the Town of Riga outside the Village of Churchville may vote; and
 
      C. A permissive referendum where only owners of property within the proposed Riga Water Improvement Benefit Area No. 1 may vote.       
 
An abstract of said Resolution is as follows: the Town Board authorized the construction of a water improvement within the Town of Riga in an area to be known the Riga Water Improvement Benefit Area No. 1 which will include approximately 138,930 linear feet of water main, and other related equipment, and will serve all residents in the Town of Riga not currently served with public water. The maximum amount proposed to be expended for such water improvement is Nine Million Dollars ($9,000,000) and said costs shall be financed from the issuance of bonds, notes, certificates or other indebtedness of the Town of Riga for a period not to exceed forty (40) years; and from the Host Benefit Agreement Reserve Fund established by Local Law No. 3 of 2008. The costs of said water improvement are to be apportioned / paid as follows:
      A) One Million Eight Hundred Thousand Dollars (1,800,000) shall be transferred from the Host Benefit Agreement Reserve Fund to the capital fund for the project and shall be used to pay initial project capital costs; and
      B) Subject to future appropriations being made by the Town Board, a maximum of Three Million Four Hundred and Fifty Thousand Dollars ($3,450,000) shall be transferred from the Host Benefit Agreement Reserve Fund to the project's capital fund for repayment of debt service; and repayment of the balance of the debt service relating to the project shall be borne by the several lots and parcels of land located in the benefited area in just proportion to the amount of benefit which the water improvement shall confer upon such lots or parcels of land; and
      C) In the event that all or a part of the Host Benefit Agreement Reserve Funds referred to in paragraph (B) above are not appropriated or are insufficient for repayment of debt service relating to the Riga Water Improvement Benefit Area No. 1, then
                  1) Seventy-Two Percent (72%) of said costs shall be borne by the several lots and parcels of land located in the benefitted area in just proportion to the amount of benefit which the water improvement shall confer upon such lots or parcels of land; and
                  2) Twenty-Eight Percent (28%) of said costs shall be borne by the area of the Town of Riga outside the Village of Churchville.   If any of said water improvement costs are borne by the area of the Town of Riga outside the Village of Churchville, such costs shall be assessed, levied and collected from the several lots and parcels of land in such area in the same manner and at the same time as other town charges; and
 
      D) The formula to be used to assess costs within the benefited area shall be as follows: 40% of the annual costs to be assessed will be based on a unit charge system, with a unit defined as follows: residential and commercial properties: 1 unit; vacant lots: 0.5 unit; landlocked parcels: 0 unit; and 60% of the annual costs to be assessed will be based upon the assessed valuation of the taxable parcels within the benefited area.
 
      NOTICE IS ALSO GIVEN that the Town Board of the Town of Riga declared the proposed water improvement project a Type I action under the provisions of the State Environmental Quality Review Act (“SEQRA”), and on December 29, 2009 the Town Board, as Lead Agency, determined that the project will result in no significant “adverse environmental impacts” and (b) that no "environmental impact statement" need be prepared, as such quoted terms are defined in SEQRA. The Town Board’s resolution and notice of negative declaration of the Town Board are on file in the Office of the Town Clerk and posted on the Town Clerk’s Bulletin Board where the same shall be available for public inspection during business hours, and said documents are also posted on the Town of Riga’s web site: www.townofriga.org.

        SEQRA DETERMINATION OF SIGNIFICANCE
       RIGA WATER IMPROVEMENT BENEFIT AREA NO. 1

            WHEREAS, the Town Board of Riga shall consider the approval of the construction of water improvements in the Town of Riga outside the Village of Churchville in an area known as the Riga Water Improvement Benefit Area No.1, all of which is located in the Town of Riga, County of Monroe and State of New York; and
 
             WHEREAS, as project sponsor, the Town Board directed the Town Engineer, Chatfield Engineers, P.C., to prepare a Full Environmental Assessment Form, a copy of which is on file with the Town Clerk; and
 
            WHEREAS, all involved agencies, as the same are defined by SEQRA and the regulations promulgated thereunder, were duly advised, by written notice dated November 12, 2009, that the Town Board of the Town of Riga intended to declare itself Lead Agency and requested any involved agency objecting thereto to contact the Town of Riga within thirty (30) days; and no involved agency objected to the Town of Riga being designated Lead Agency; and
 
            WHEREAS, all involved agencies were mailed or delivered a copy of Part 1 of the Full Environmental Assessment Form together with the notice that the Town Board intended to declare itself Lead Agency; and
 
            WHEREAS, the Town Board has duly reviewed and considered the Environmental Assessment Form, the Engineer's Report for the proposed Riga Water Improvement Benefit Area No.1, the Preliminary Notice of Intent filing prepared for the project by the Town Engineer under the provisions of the Agriculture and Markets Law, as well as all the evidence and information obtained at a public hearing held on December 16, 2009 at 7:00 p.m. relating to the water improvement project, and the Board has duly considered the impacts which reasonably may be expected to result from the proposed action by using the criteria set forth in Article 8 of the Environmental Conservation Law, the State Environmental Quality Review Act, and applicable regulations promulgated thereunder ("SEQRA"); 

     NOW, THEREFORE, BE IT RESOLVED by this Town Board as follows:
 
            1. That the Town Board of the Town of Riga declares itself Lead Agency for review of the project.
 
            2. That based upon the review and consideration by the Town Board of all of the evidence above described, the Board hereby finds that the object of the above-referenced action, and approval of any financing therefore, (a) will result in no significant “adverse environmental impacts” and (b) no "environmental impact statement" need be prepared, as such quoted terms are defined in SEQRA. The notice of negative declaration of the Town Board is attached hereto and made a part of this resolution for the purposes of SEQRA. This determination constitutes a negative declaration for purposes of SEQRA.
 
            3. That the Town Board’s determination is based upon the reasons set forth in the notice of negative declaration attached hereto, said reasons being incorporated herein by reference..

Description of Action:
 
The Town of Riga proposes to create a Water Improvement Benefit Area to serve the remaining portion of the Town not currently on public water. The proposed improvements will consist of a strategic extension of the existing water distribution system to serve the approximately 284 homes currently not on public water plus approximately 21 businesses and commercial properties. 
 
The Project includes the installation of approximately 138,930 linear feet of 6-12” diameter Class 51 Ductile Iron Pipe (DIP) with fire hydrants generally spaced at 600 feet intervals. Fire hydrants are generally located near intersections to provide improved fire fighting capabilities. Gate valves are generally spaced at intervals of 1,000 linear feet and at intersections. All improvements will be completed in accordance with the MCWA Standards.

Although this project includes multiple stream crossings of varied categories the appropriate mitigation efforts, including erosion controls and adherence to all storm water regulations will be taken to protect surface runoff. Permit compliance with NYS DEC and US Army Corps of Engineers will be obtained prior to any construction activity. Similar mitigation efforts and compliance to environmental regulations will apply to project design on Robertson Road in a small area of NYS Regulated Freshwater Wetland.
 
The project will address the pressing public health and safety needs, which result from dependence upon individual on-site wells that produce water of limited quality and quantity. The project may provide some opportunity for additional growth within the Water Improvement Benefit Area, since a safe and reliable water supply and fire protection will be available. However, the intent of the project is to meet the existing needs, not to promote growth. The impacts of additional growth are expected to be minimal. No change in the zoning will result from this project.    The project will improve the overall quality of life for the residents of the water benefit area.
 
The estimated water use within the new project area is approximately 66,000 gallons per day. The water will be supplied by the Monroe County Water Authority. There is ample supply to meet this additional demand. Since residents will be discontinuing use of their existing wells, the use of existing groundwater supplies will be reduced in the project area.
 
Although the project will require some water main installation within the 100 year flood plain of Black Creek, it will not result in any adverse impact to the flood plain.
 
The well supplies in the project area have a history of producing limited yields and poor quality water. The project will reduce the dependency on individual well supplies; and provide water that is treated and tested to meet public health standards. The project will also improve firefighting capabilities in the project area.
 
Any negative effects of construction activities will be minimal and temporary in nature. Using proper silt fence and erosion control measures will ensure minimal impact.
 
There will be no adverse impact on plants and animals that make this their habitat.
 
The installation of the watermain will not affect the character, present use or any potential future use of the land and surrounding area. They will enhance the residents’ use of their properties.
 
Chatfield Engineers conducted the SEQR Environmental Assessment for this project.

APPROVAL OF THE RIGA WATER IMPROVEMENT
BENEFIT AREA NO. 1
     UNDER ARTICLE 12-C OF TOWN LAW
__________________________________________________________
     
      WHEREAS, on February 11, 2009, the Town Board of the Town of Riga duly adopted a resolution directing the Town Engineer, Chatfield Engineers, P.C., to supervise the preparation of a general plan, report and map for providing water improvements (water mains, fire hydrants, and all related equipment) in portions of the Town of Riga located outside the Village of Churchville, said area to be known as the Riga Water Improvement Benefit Area No. 1; and
 
      WHEREAS, the proposed water improvement will include approximately 138,930 linear feet of 6-12 inch diameter ductile iron pipe water main and will serve all residents not currently served with public water. Water services consisting of 1 inch minimum Type K cooper tubing will be provided to improved residential and commercial properties at the road right of way line. The water distribution system will also include the normal appurtenances, such as line valves, fire hydrants, air release valves, blow-off valves and related items. The water distribution system will be constructed in one or more phases (or contracts) and will be installed within, or along side of, the road right of ways within the proposed water improvement benefit area that do not have public water; and
 
      WHEREAS, on November 5, 2009, the Town Engineer duly filed said plan, report and map in the Office of the Town Clerk of the Town of Riga; and the Town Board did, on November 11, 2009, duly adopt an order reciting the improvement, the maximum amount proposed to be expended for the improvement, the proposed method of financing to be employed (including the use of Host Benefit Agreement Reserve Funds for the project), the proposed method of apportioning the costs of said improvement, the fact that a plan, map and report describing the same are on file in the Town Clerk's Office for public inspection, and specifying that said Town Board shall meet at the Churchville-Chili Middle School Auditorium located on Fairbanks Rd. in the Town of Riga, New York on the 16th day of December, 2009, at 7 P.M. for the purpose of conducting a public hearing on such proposal to provide such improvement and to hear all persons interested in the subject thereof; and
 
      WHEREAS, such order was duly posted and published as required by law; and
    
      WHEREAS, a hearing in the matter was duly held by the Board on the 16th day of December, 2009, commencing at 7 P.M. at the Churchville-Chili Middle School, and considerable discussion upon the matter having been had and all persons desiring to be heard having been duly heard;
 
      NOW, THEREFORE, upon the evidence obtained by the Town Board at the December 16, 2009 public hearing and upon all other information obtained and reviewed by the Board, it is hereby
 
      RESOLVED AND DETERMINED that the notice of hearing was published and posted as required by law and is otherwise sufficient; and be it further
 
      RESOLVED AND DETERMINED that it is in the public interest to provide for the water improvement above described; and it is further
 
      RESOLVED AND DETERMINED the boundaries of the area within the Town of Riga being benefited by said water improvement are set forth in Schedule A attached hereto and incorporated herein by reference; and be it further
 
     RESOLVED AND DETERMINED, that the maximum amount proposed to be expended for such water improvement (including the cost of construction, easements, engineering fees, legal fees and financing fees) is Nine Million Dollars ($9,000,000); and be it further
 
      RESOLVED AND DETERMINED, that the costs of the proposed water improvement shall be financed from the issuance of bonds, notes, certificates or other indebtedness of the Town of Riga for a period not to exceed forty (40) years; and from the Host Benefit Agreement Reserve Fund established by Local Law No. 3 of 2008 and approved by the electors of the Town of Riga at the General Election held on November 4th, 2008 (hereinafter referred to as “Host Benefit Agreement Reserve Fund”); and be it further
 
      RESOLVED AND DETERMINED that the costs of said water improvement be apportioned / paid as follows:
      A) Upon final approval of the project and creation of the Riga Water Improvement Benefit Area No. 1, One Million Eight Hundred Thousand Dollars (1,800,000) shall be transferred from the Host Benefit Agreement Reserve Fund to the capital fund for the project and shall be used to pay initial project capital costs; and
      B) Subject to future appropriations being made by the Town Board, a maximum of Three Million Four Hundred and Fifty Thousand Dollars ($3,450,000) shall be transferred from the Host Benefit Agreement Reserve Fund to the project's capital fund for repayment of debt service; and repayment of the balance of the debt service relating to the project shall be borne by the several lots and parcels of land located in the benefited area in just proportion to the amount of benefit which the water improvement shall confer upon such lots or parcels of land; and
      C) In the event that all or a part of the Host Benefit Agreement Reserve Funds referred to in paragraph (B) above are not appropriated or are insufficient for repayment of debt service relating to the Riga Water Improvement Benefit Area No. 1, then
                  1) Seventy-Two Percent (72%) of said costs shall be borne by the several lots and parcels of land located in the benefited area in just proportion to the amount of benefit which the water improvement shall confer upon such lots or parcels of land; and
                  2) Twenty-Eight Percent (28%) of said costs shall be borne by the area of the Town of Riga outside the Village of Churchville.   If any of said water improvement costs are borne by the area of the Town of Riga outside the Village of Churchville, such costs shall be assessed, levied and collected from the several lots and parcels of land in such area in the same manner and at the same time as other town charges; and
 
      D) The formula to be used to assess costs within the benefitted area shall be as follows:
                  1) 40% of the annual costs to be assessed will be based on a unit charge system, with a unit defined as follows:
 
Residential and Commercial Properties: 1 unit
Vacant Lots: 0.5 unit
Landlocked Parcels: 0 unit
 
                  2) 60% of the annual costs to be assessed will be based upon the assessed valuation of the taxable parcels within the benefited area; and be it further
 
      RESOLVED, that within ten (10) days after the adoption of this resolution, or within ten (10) days after the Town has received any necessary approval from the State Comptroller, whichever is later, the Town Clerk shall file a certified copy of this resolution in the Monroe County Clerk's Office; and be it further
 
      RESOLVED, that since the costs to be financed by issuance of debt instruments exceeds one-tenth of one percent (.01%) of the full valuation of the taxable real property within the Town of Riga located outside the Village of Churchville, the Town Clerk shall caused to be filed two certified copies of this resolution with the office of the State Department of Audit and Control, at Albany, New York, together with an application by this Board in duplicate for approval of the State Comptroller as provided by the Town Law, Section 209-q; and that such application shall be executed by and in behalf of the Town by the Supervisor of the Town; and it is further
 
      RESOLVED, that this resolution is subject to:
 
      A. A permissive referendum where all town electors may vote; and
 
      B. A permissive referendum where only owners of property located in the Town of Riga outside the Village of Churchville (part-town property owners) may vote; and
 
      C. A permissive referendum where only owners of property within the proposed Riga Water Improvement Benefit Area No. 1 may vote; and be it further            
 
      RESOLVED, that the Town Clerk, within ten (10) days of the adoption of this resolution, shall cause to be published and posted, as required by law, a notice setting forth an abstract of this resolution, the date that it was adopted and a statement as to that it is subject to three (3) permissive referendum as set forth above.
